Just about every divorce will require a QDRO. What is a QDRO? A QDRO is a Qualified Domestic Relations Order, which is a very technical order required to effectuate the division of most retirement assets after divorce.

Whether you know it or not, if you are divorced, or getting divorced, and there are retirement assets to divide (such as you are supposed to get half of your spouse’s 401k), then you need a QDRO.

Chances are high that your attorney told you about this in passing, told you to hire a joint QDRO lawyer, or maybe the Court even ordered for you and your spouse to hire a joint QDRO lawyer.

However, due to the emotional toil a divorce can take on you, when the divorce decree is entered, the last thing on your mind is more court or more lawyers.

Even if your divorce decree says you get 50% of your spouse’s retirement assets (401k, pension, etc.), a QDRO will almost certainly be required in order for this to actually take place.

Here’s a question: if your decree orders you to get a portion of your spouse’s retirement, can you identify how and when you actually received those funds or benefits? Most likely you cannot because you did not receive them yet because you did not get a QDRO done.
